Housing, Justice, Education, and Equality in Palm Beach, Broward, and Miami-Dade Counties are all predicated upon who you are and what you have (money). Sadly, for those children who find themselves in delinquency court, the public defender or regional conflict counsel are your first options. . . But they are not your ONLY options.

We handle Juvenile Delinquency matters on a case by case basis.  Our selective process is based upon the parents, not the child or the case.  If the Parents are unmotivated or simply want to get their child "OFF," we WILL NOT take your case.  

When we take Delinquency case, we do so ONLY with the promise and assurance from the parent(s) and child that this will never happen again, and a commitment to their child's education!   We will not take repeat offenders.

DOES AN ADJUDICATION OF DELINQUINCY AFFECT ADULT SENTENCING? - YES. 

Sentencing Enhancements: The juvenile delinquency record triggers sentencing enhancements in both the state and federal criminal systems.

Florida Criminal System:

  • The Florida Criminal Punishment Code defines any prior record as any conviction regardless of whether there is a withhold for offenses whether committed by an adult or juvenile.

  • Juvenile dispositions of offenses committed by the offender within 5 years before the date of the commission of the primary offense must be scored as prior record.

  • Juvenile dispositions of sexual offenses committed by the offender more than 5 years before the date of the primary offense must be scored as prior record if the offender has not maintained a conviction-free record, either as an adult or as a juvenile, for a period of 5 consecutive years.

Federal Sentencing:

  • A juvenile adjudication also may enhance a sentence in the federal criminal system. 

JUVENILE AND DEPENDENCY LAW

THE SCHOOL-TO-PRISON PIPELINE STARTS IN JUVENILE COURT

States like Florida lead the nation in charging juveniles (minors under 18) as adults.  When minority children are charged as adults, often, their potential penalties are much more harsh than white juveniles or the more affluent. 

Because so many majority-minority populated schools are unequal, sentencing severity is often predicated on the poor success of these children in these school, leading to records that carry forward when/if they get charged in adulthood.

EQUALITY AND FAIRNESS RARELY EXISTS WHEN PROTECTIVE SERVICES ARE CALLED

Minority and working poor White parents often face stiffer and harsher allegations from state child protective services like Florida's Dept. of Children and Family (DCF) due to cultural insensitivities and general cultural ignorance. Most often, CPS allegations are the result of biases and prejudices from the CPI (Child Protective Investigator) or Attorney representing the case.  In Palm Beach County, there is ZERO diversity in their Investigative Legal Dept. 

Parental Civil Rights are often abused under the guise of "protecting children" in Dependancy Court.
